About Us
McGinley Wills and Probate Solicitors is a family-run law practice established in la Costa del Sol since 2026. We assist English nationals in the UK, Costa del Sol and Switzerland.
The firm's managing partner and legal consultant, Barry McGinley has more than 45 years experience dealing in complex cross-border estates, setting up trusts, estate planning and advising clients regarding their Wills. He has worked as a Solicitor in several countries such as the UK, Monaco, France and Switzerland. He has extensive experience in setting up companies and is also currently working as a Legal Adviser for our sister company Jurisconsult S.A., a law firm based in Geneva, Switzerland.
He specialises in complex cross-border probate matters.
Tracey McGinley is the firm's senior partner. She is an English Solicitor registered with the Solicitor's Regulation Authority and has 12 years experience working in Wills and Probate. She has worked for firms around the South West of England before relocating to Spain. She also worked for firms based in Chile, France and for Jurisconsult S.A, in Switzerland.
She specialises in Wills (English and International) and Lasting Powers of Attorney. She also assists clients with their applications for Spanish residency and their visa. She has a wide range of contacts in la Costa del Sol (Notaries, Spanish Lawyers and Estate Agents) who can assist where required.
We are a forward thinking law practice and offer face-to-face meetings as well as online meetings.

We offer competitive fees and some of our work is handled on a fixed fee basis. Other types of work depending on complexity will be charged on an hourly rate basis but we aim to be transparent throughout the process. We update our clients regularly regarding our fees and disbursements and seek their approval before undergoing further work.

We are constantly developing our skills and legal knowledge. Tracey is an Affiliate member of STEP (Society of Trust and Estate Practitioners) and you can find her in their member directory. She has recently achieved a merit in the Cross-border Advanced Certificate and is planning to gain full membership.
Our Practice Areas
Wills
We offer different types of Wills to suit our clients' needs. We prepare simple Wills but also more complex Wills which are tax efficient and aim to protect your assets.
Lasting Powers of Attorney
We prepare Lasting Powers of Attorney for Property and Finance and Health and Welfare. We guide you throughout the process and liaise with the Office of The Public Guardian for registration. We also supplement these legal documents with Letters of Wishes and act as the Certificate Provider.
Deputyship orders
We help you with applying for a Deputyship order and advise you throughout this complicated process.
Enduring Powers of Attorney
We register your existing Enduring Power of Attorney with the Office of The Public Guardian.
International Probate
When a loved one dies, we assist you throughout this difficult process which can be overwhelming. We establish the deceased's domicile and habitual residence and ascertain whether there is any Inheritance Tax to pay and especially in which country. We prepare the Inheritance Tax forms and probate applications. We Iiaise with the tax authorities on your behalf and apply for a Grant of Representation or an Inheritance Certificate.
Estate planning
We help you mitigate your Inheritance Tax liability and assess which legal or financial product would suit your needs.
Trusts and Trust Registration Service
We set up lifetime trusts but also Will trusts depending on your circumstances and what you wish to achieve. We also assist you with registering Will trusts and estates on HMRC's Trust Registration portal.
Mental capacity assessment
We prepare legal mental capacity assessments.
We also help English nationals apply for their residency permits in Spain.
If you plan to move to Spain and require assistance with your visa application or residency permits please get in touch.
We also certify clients’s identification, legal documents and the Department for Work and Pension’s life certification form.
Our fees are competitive and our client service is first-class.
Some of our fees vary depending on your instructions and are exclusive of disbursements such as ID checks.

Wills
Simple single Will - 325 euros.
Complex single Will - 500 euros.
Simple mirror Wills - 475 euros.
Complex mirror Wills - 650 euros.
International Probate
Our fees are based on the Law Society's guidance of 1% to 3% of the estate value (excluding disbursements such as Probate fees and Notary fees).
Lasting Powers of Attorney
1 Lasting Power - 450 euros.
2 Lasting Powers - 575 euros.
4 Lasting Powers - 650 euros.
Plus Registration fee with the Office of The Public Guardian (£92 per Lasting Power).
